ENABLING RESOLUTION
A
regular meeting of the Common Council was held in the Common
Council Chambers of the municipal building, Peekskill, New York on
March 14, 2005, beginning at 8:22 p.m., with Mayor John G.
Testa presiding, following one public hearing.
Present were:
Councilmen Donald Bennett, Melvin Bolden, Councilwomen Drew Claxton,
Milagros Martinez, Councilman William Schmidt, Deputy Mayor Catherine
E. Pisani and Mayor John G. Testa.
Also present were: City
Manager Daniel W. Fitzpatrick, Corporation Counsel William J.
Florence and City Clerk Pamela Beach.

BUSINESS
Councilwoman Martinez offered the following
resolution, moving its adoption:
Local
Law No. 4 of 2005 re: Amending Section 300-48 of the Code of the City
of Peekskill Entitled "Certificate of Occupancy" -
Approved
WHEREAS, on January 10, 2005 a proposed Local
Law was placed on the desks of the members of the Common Council to
amend section 300-48 of the Code of the City of Peekskill entitled
"Certificate of Occupancy", and;
WHEREAS, on
January 24, 2004, a public hearing was held on said Local Law in the
Common Council meeting room, City Hall, Peekskill, NY after due
publication of said notice of Public Hearing, and;
WHEREAS,
said Local Law has been on the desks of the members of the Common
Council in its final form for at least seven (7) days, exclusive of
Sundays.
NOW, THEREFORE, BE IT RESOLVED, that said
Local Law be and the same is hereby adopted and shall be known as
Local Law ¹ 4 for the year 2005 in the City of Peekskill.

LOCAL LAW INTRO No. 4 OF 2005 AMENDING SECTION 300-48 A OF THE CODE
OF THE CITY OF PEEKSKILL ENTITLED "CERTIFICATE OF OCCUPANCY"
BE
IT ENACTED by the Common Council of the City of Peekskill, New
York, as follows:
Section 1. Section 300-48 A of the Code of the City of Peekskill requiring Certificates of Occupancy is hereby amended to read as follows:
§ 300-48. Certificate of occupancy.
A. The following shall be unlawful until a certificate of occupancy shall have been applied for and issued by the Director:
(1) Occupancy and use of a building hereafter erected, structurally altered or moved, or any change in the use of an existing building.
(2) Occupancy, use or any change in the use of any land.
(3) Occupancy or use after sale or transfer of any improved real property including a condominium. Upon sale or transfer of any such real property an updated certificate of occupancy, issued no earlier than 30 days before closing, shall be required before the premises may be used or occupied. It shall be the obligation of the seller to apply for and obtain the updated certificate of occupancy unless the parties agree otherwise in their contract of sale.
Section 2. This Local Law shall be effective on January 1, 2006 or upon filing in the office of the Secretary of State, which ever occurs later.
